These Terms of Service ("Terms") govern your access to and use of empireremodelindex.com and its content and services (the "Site"), operated by Empire Remodel Index ("we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. What the Site is
Empire Remodel Index is an independent directory of kitchen and bath remodeling contractors in New York State. We provide free informational listings compiled from public sources and may offer clearly labeled "Sponsored" promotional placements. We are a directory and advertising service only — we do not perform remodeling work, act as a contractor, or broker contracts between you and any listed company.
2. Use of the Site
You agree to use the Site only for lawful purposes. You may not: (a) scrape, harvest, or bulk-copy listing data except for your own personal, non-commercial reference; (b) use the Site to send spam or unlawful communications; (c) attempt to disrupt, overload, or gain unauthorized access to the Site; or (d) misrepresent your identity or your authority to act for a listed company.
3. Listings and accuracy
Listing information is compiled from publicly available sources and may be incomplete, outdated, or inaccurate. We make no warranty as to the accuracy of any listing. Your reliance on any listing is at your own risk, and you should verify all details directly with the contractor. 4. Claiming, correcting, or removing a listing
If you own or represent a listed company, you may request corrections to, or removal of, your free listing by emailing us. We will make reasonable efforts to update or remove the listing promptly. We may keep a listing live unless and until the authorized owner asks us to remove it.
5. Sponsored listings (pilot and paid service)
- What it is. A Sponsored placement is advertising that may appear above standard results in one region. It is labeled "Sponsored" and does not change the advertiser's public rating or imply our endorsement.
- Founding pilot. An accepted founding placement is 60 days free. We do not bill during the pilot. Continuing after the pilot costs $49 per month only after the participating company expressly approves continuation.
- Availability. We offer at most one Sponsored placement per region during the founding pilot. A placement is not reserved until we confirm it in writing.
- Term and cancellation. Paid Sponsored placements are month-to-month. You may cancel at any time, effective at the end of the current billing period. Fees already paid are non-refundable except where required by law.
- No guarantee of results. A Sponsored placement is advertising. We do not guarantee any number of views, calls, leads, customers, revenue, or any other result.
- Our discretion. We may decline, modify, pause, or remove a Sponsored placement or listing for inaccurate information, non-payment, unlawful conduct or other reasonable trust and safety concerns. If we remove a paid placement other than for your breach, we will refund prepaid fees for the unused portion of that month.
- Price changes. We may change pricing on a going-forward basis with reasonable notice. The $49 founding price is held for 12 months while the placement remains continuously active.
6. Intellectual property
The Site's design, text, and original compilation are owned by us and protected by applicable law. Company names, logos, and marks belong to their respective owners and appear for identification only. You may not copy or reuse the Site's content except as permitted by these Terms or applicable law.
7. Third-party links
The Site links to third-party pages (such as Google Maps profiles). We do not control and are not responsible for third-party sites, their content, or their privacy practices.
8. Disclaimer of warranties
The Site and all listings are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of the Site or your dealings with any listed contractor. Our total liability for any claim relating to the Site or a Sponsored placement will not exceed the amount you paid to us in the three (3) months before the claim arose (or, if you paid nothing, USD $100).
10. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Site, your breach of these Terms, or, if you are a listed company, the content or accuracy of information you ask us to publish.
11. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above reflects the current version. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in New York.
